   • Nothing in this clause 4 precludes the recovery of loss or damage under these terms and conditions which may fairly and reasonably be considered to arise naturally, in the usual course of things, from gross negligence or wilful misconduct of a party, except to the extent the other party caused or contributed to the loss or damage. 
   • Each party must use its best efforts to mitigate any loss or damage.
     
5. Capped liability
   • Subject to clause 4 above, the maximum aggregate liability of either party for all claims, suits, losses, damages, costs and expenses under or relating to these terms and conditions or its subject matter is limited to the value of the Services provided to that party in the last 12 months.

   • All content on this website, including text, graphics, logos, and images, is the property of Purser Wines Pty Ltd or its content suppliers and is protected by Australian and international copyright laws.
7. Governing Law
   • These terms and conditions are governed by the laws of the state of Victoria in Australia. Any disputes arising from these terms shall be resolved in the courts of that jurisdiction.
